The puppies mature into allergy friendly dogs. And, all the offspring possess positive qualities, such as awesome beauty, babydoll faces, nonshed soft coats, unique colors. New Wisconsin Dog Laws
(get comfortable-this reading will take awhile....deep sigh.)
The State of Wisconsin has New long-overdue puppy dog Laws. This is a great benefit for all: puppies, reputable breeders, dog lovers, and state revenue. The new laws are to be enforced June 1st. 2011.
From what we can tell, so far, the new Laws are not exactly ideal but its a start! We all want to do our part, to cooperate with the best of our ability. Remembering, the bigger picture - A New start for greater protection of our wisconsin puppy dogs, and to put a end to "all" puppy mills. It's a start.
But, be aware. The New Laws are not exactly Consumer or Breeder Friendly.
The Many Unreputable Breeders in Wisconsin who advertize in local newspapers or commonly know as Backyard Breeders (BYB) are leagally allowed to sell Inferior Puppy Dogs Indefinitely. And, the Reputable Breeder was slapped with the bulk of the cost of new changes. WDATCP (Wisconsin Department of Agriculture, Trade and Consumer Protection) fell short of protecting the consumer and reputable breeders - which should have been given more consideration. Time will not allow us to give you all the problems but here are a few.
Problem #1 > Any Breeder selling over 24 puppies per year will be regulated by the new WDATCP Laws. (Exhaustingly & Heavily) But, any Breeder selling under 24 puppy dogs per year are not under any regulations by laws whatsoever. (24 must be a Special # ?) I asked a WDATCP Member on the Board about this. She replied, if theres a puppy problem from a breeder selling under 24 puppies..."the consumer can always file a complaint" or use the small claims court. So, "small claims" court is your solution.
Problems with Small Claims Court: A Few of Our experience's.
> We were innocent and still lost. Long Story short....I told the judge the other party was lying and produced the sales contr to show accurate facts in our defense. Well, the judge looked at me and said..."We're not here for justice,
we're here to resolve problems". WOW!, we took a speechless step back. That meant someone had to give in to end the dispute. Which we did. As we couldnt visualize the other party who was already clearly "lieing" suddenly acquire a conscience. And, if we pushed ahead anyway that would have resulting in harm to the said puppy. As, that puppy would have to go to the humane society to wait in legal limbo till this could be resolved. Which could go on for months. We just couldnt do that. So, we took the hit but helped the puppy. Which is living happily w/ another Breeder now. One must acknowledge what the judge said as the truth. Sometimes the courts are not here for "Justice." They must be filled with so many cases that could be resolved providing someone giving in to end the dispute > right or wrong.
Our next court experience. In short, we purchased 3 Pom puppies from a woman in Wausau Wi. who claimed they were vaccinated and vet checked. However, after recieving them we came to find out the Vet they used never heard of them! The woman would not return calls or certified letters. We thought this breeder should not get away with that, and it was so obvious and easy to prove per Vets statement. We were sure to win, right? Wrong. We lost. It was sureal.
Another Reputable Breeder from Green Bay, Wi. purchased two purebred yorkies from a Breeder in Pound, Wi. Both puppies died w/in a few wks. The Reputable Breeder had alot of vet bills and expenses. And, the breeder would do nothing. Small claims courts do not judge in favor of the Reputable breeder. She lost, alot.
All cases involved going to court about 4x for me and several more times for the other Reputable Breeder, along with taking off work. Plus we paid the
court fee's, and the out-of-pocket money lost in expenses made from the puppy themselves care which took us to court to begin with.
So, what would a consumer chances be for justice?
Problem # 2 > Besides the "not always fair" court system, there's alittle problem with the New "puppy health checks" (C.V.I). Health Checks are good, but how they decided to do them is a real pain. Problem: They made Three different forms pending on the final destination of the puppy. Instate, Out of state via plane, Out of state via car.
And, there are 3 different price's for each. Vets buy these forms from WDATCP for a mere 1.60 ! Yet, 95% of the Vets mark them up ALOT. Few do not. The adverage costs is 16. up. One vet in Oconto Falls (10min. from our house) charges 84. for a out-of-state Vet Health Check for one puppy.
And, all out-of-state health checks need to be made out in advance of the person buying the puppy.
Problem # 3 > How does a breeder predetermine that party will take that puppy-so to have that form ready when they come? What if that party doesnt want that puppy or chooses another one. How are we suddenly suppose to micracously produce the required document for that puppy in their name? Sadly partys need to return another time when form is ready for their puppy. Most people cannot make two trips here especially driving 2-4 hrs one way. Or they can commit to buying that puppy before they arrive here. Allowing us time to have the form ready for them. This puts many buyers who don't know us in a uncomfortable position. Like buy before you see.
I asked WDATCP about this costly inconvenience to buyer having to return a second time for the Out of state Health Check in their name. Her response was, "oh, well, they'll just have to make two trips". Many times now, some puppies have had 2-3 C.V.I's !!!! As people can change their mind when a instate C.V.I is done. There's all kinds of scenarios that are created. The C.V.I's are good for 10-30 Days. After that a new or updated one is required. Causing puppies to have several C.V.I's Back to the Vet, more cost, more time, more exposing them to virus's.
Problem #4 > Consumer will have more expense for their puppy. And the more C.V.I's the more cost of puppy. So, Reputable Breeders will have lost sales and good homes for their puppies. This horribly planned Expensive Law effects us both. And, what about the protecting the puppies!
Problem # 5 > WDATCP requiring C.V.I forms in this way are exposing the puppys to ongoing Vets Visits exposing them to Virus's. A "Virus" is horrible ongoing contagious warfar. And the puppy and puppy owner is not always the winner. The best place to be exposed to a Virus is at the Vets Office.
So, here's what we have: Besides these Few problems mentioned, there's more.
And are just beginning. To WDATCP some puppy mills will be shut down. But, BYB will flourish, and many Reputable Breeders (including the ones we work with) have dropped out of Breeding due to the new laws. Others are considering the same.
These are Reputable Dog Breeders, who actually raise dogs themselves with a code of ethics loyally, report their sales tax's, and have not agreed with the New Laws. Most are dealing with a lifetime of hard work, expense, & developed bloodlines. A very good position of accomplishment indeed. It took us a long time to get here, kinda nice to hang around alittle bit. Not so easy to walk away from what took you a lifetime to do. Especially, if what you did is Exceptonal.
Needless to say, Reputable Breeders need Legal Representation. Only the few Reputable Breeders we know are way too busy caring for their dogs like their family. And do not have the time, energy, funds, or stomach to deal with "Puppy Politics". That will also carry the added bonus of dealing with over zealous animal activists who have endless time and money to lobby their (well meaning but misguided) personal opinions / beliefs of puppy dogs. Which have found their place in some of these new laws. In the meantime, Reputable Breeders will be bearing the blunt of hardship imposed on them by the New Laws. And, then the consumer. It was almost predictable.
Your needing to pay more for a Quality puppy dog. Because, to no fault of our own-the cost to offer this type of puppy is much higher now. Note: adopting a pet companion for 15yrs. needs to be of Quality. This is no time to cut corners when a family's safety, finances, and emotions are involved. Creating lifelong memories from positive companionship is priceless. In the scheme of things, one is better off to pay the price. One of our puppies is worth every single cent by far.
Bottom Line: In our opinion, the new Laws are in effect, throwing out the baby with the bath. Reputable Breeders have be too discouraged, exhausted and broke to continue their exceptional labor-of-love work as a Ethical Dog Breeder. We say, "labor-of-love" because, the general public is not aware of the amount of TLC and time we put into raising awesome puppies. In reality though, the money from a puppy sale is not the real reward. It's only a tangible piece that helps us have worth while work with our passion. The real reward to a reputable breeder is much more. And, "if" you take pride in your work - the rewards are greater still. Please note: We do not know of any rich reputable breeders. Not one! This isnt a business to get rich on. Our tax woman can tell you that.
Today, Sadly, some of your Wisconsin Reputable Breeders have choosen to drop out due to the Excessive New Laws here. Some have moved out of Wisconsin to start up somewhere else, and some are planning to move. Gulp. That means, in our case, We're losing some of our positive network system of support. We need each other. We cannot breed back to our own bloodlines. Totally seperate lines are required in a clean breeding program. That being said, Question: Who else is going to demand a clean breeding program, offer Guarantees because they know their bloodlines, and try to improve or upgrade each litter better than the one before? Who else is going to breed seriously beautiful, healthy and fun loving stable puppies? Who else is going to submitt to several Unresasonable Laws with added expenses in time and money? Really, who? Not many, thats for sure. But, there will be many BYB who cheat-lie-cut back-breed anything, and resort to untold selling practices. And, now they get away with it. It's alot harder to do what we do.
Our standards are high. We're sort of all the public has now. And, we're starting to feel like we're on the border of extincion. We have a 30 year span in Wisconsin as Reputable Dog Breeders. In all that time, besides us and some others - we are the minority by far. (too far and getting farther everyday)
Also, with less of us - plain and simple...Not only did the price of your puppy go up. Your "puppy selection" just got reduced. Less Reputable Breeders = Less Quality Puppies. Instead, you can say hello to, "Unreputable BYB and those Breeders who choose to fly under the conscience radar". When both really need to Fly Away all together! (we're almost done, i promise)
This is how it is.
Most Unreputable BYB - Newspaper Ad Breeders Operate Without:
> a code of ethics.
> reporting sales tax or the income from puppy sales. Thats 24 pups Annually = 12,000. up.
> vaccine/dewormings. Although, they may buy a 7way vaccine from fleetfarm with Lepto, which is known to be harmful for Morkies, Shorkies, and Maltipoos.
> Any real Health and/or no Temperament Guarantee.
> Costly Puppy Health Checks.
> License Fees from County. (most unreputable byb have more dogs than their county allows
but are only licensing for a few).
> State Laws, regualtions, record keeping, inspections....
> Increased Advertizing Costs. Newspaper Ads are approx.10. for them. A Reputable License
breeder needs to pay approx. 50.+ per ad, and having to use their State Lic. # in each ad.
making their Ad bigger resulting in the reputable breeder having to pay more.
> A Clean-Solid Breeding Program. Pretty much the stud is the neighbors dog down the block. With no regard to parents genetics, health, not to mention temperament.
But, as long as we're on the subject. Here's why i bring up "temperament".
Our Two Cents: Reputable Breeders Rule!
Despite:
> Excessive reguations Per DATCP. Quality Breeding goes on.
> A Mountain of paperwork (that we have to keep for 5 years for each puppy Per
DATCP. And if there's any error in paperwork or your Kennel Operations, there
are fnes: hundreds to 10,000. and Jail Time. How'd you like to work with that
on a daily basis?
> License fees to Operate are 250.-1,000. Not counting the County Lic. fee's.
> Maintenance Costs of: Foods, Herbs, Vitamins, Care, Supplies, nursery, kennel,
grooming, infloor heat, a/c, kitchen appliance's to office....
> Maintenance Vet Bills. Teeth cleaning (this alone is outrageously expensive for
several dogs almost each year). In addtion- I personally brush - scale tool - dogs
teeth often. In case, you didnt know...Nothing is worse and more time consuming than cleaning each dogs teeth!!! Nothing. This is by far my least favorite job!!!!!!!
Then there's Rabies, Research testing.....
> Inspections with potential harm (traveling inspectors with possible viural / bacterial from kennel to kennel). Per DATCP. In addition to harm, there are unreasonable
Inspectors more than ready to "End Your Small Breeding Operation ASAP".
Case in pt. Our 2011 Inspector found a possible error, after resolving the matter she was quick to report it anyway. Here's what happened. Just prior to her coming in, my husband forgot to put the bedding sheet back in w/ the mom and her nursing puppies. He left the pillow case but no sheet. She saw that and asked about it. I was surprised and embarrassed to see that and told her we always use plateforms with bedding sheets and blankets. She was standing about 3' away from the bedding baskets of clean sheets and blankets. To make matters worse, my husband also moved the platforms so i couldnt find them. We didnt even want to defend ourselves anymore so we just took the mom and puppies to another set up for them while she was standing there. None the less, she whiped-out her camera to document the pillow case prior to us fixing it. It was so upsetting and unfortunate. We asked if she could also take a pic of the potential problem being resolved...but she declined. She only wanted pics that would show problems. Which by the way, would be made public. She made it clear, that will be in our report now. And, we thought, great, we've been using bedding for how many yrs. and the time you forgot that morning-was photographed and documented! We really wanted a 100% positive Inspection, not 99.99% but a full 100% we so deserve it.
> More time and expense for trips / costs for Puppy Health Checks per the WDATCP Form. Vets charge 35.-84. in our area. The better priced vet is over a hour from us.
> Releasing puppy age for OhpuppyLove is and will always be 8wks. of age. And 10-12 wks. for Teacups. The WDATCP legalized 7 wks. of age! Which we know for a fact, is NOT healthy for the Morkie, Shorkie, Maltipoo puppy. This is going to cause alot of puppies harm with leaving to new homes too soon. Also, some lost income to the Reputable Breeder will be in store. As many Puppy Buyers want their puppies @ 7wks. or sooner. Your BYB. just got that puppy sale.
> the BYB can offer less quality puppies cheaper at an earlier age. So, some
buyers will go that route instead of a quality guaranteed puppy at a safe age.
> Outrageously High Advertizing fee's. Reputable Breeders must pay 50. up for the same ad that local BYB pay for 10. for.
> 24/7 TLC. Emotional and Physical ongoing puppy dog attention. In lieu of...baby-wedding showers, weddings, funerals, grad parties -special events, extended educational class's, volunteer work, family visits, vacations, basic undisturbed sleep, and the ups / downs of owning and caring for several puppy dogs @ one time....
>...the responsiblity of being a pack leader, fussy mom & dad to our puppy dogs, nurse, mid wife to females that start at midnight finishing the next morning, (somewhat but not equal to a home semi-vet) having to administer vaccines/ meds....,provide emergency care to regular care to everything from diarrhea - constipation. Added responsiblity of breeding manager, advertizer, record keeper office girl, puppy coach, dog rescuer, groomer, website designer, photographer, puppy cook, puppy dog currier, bedding-towels-clothes washer, nursery cleaning woman, puppy dog shopper (ok well this i rather like)....but you get my pt.?
>....No Insurance, no bonus's, no paid over time, no incentives, no grammys, no breeder-of-the-year-award, no box seats for job well done, no free tickets to the Met from our boss, no metal or pin, no plaque on the wall, no trophys, no "the real breeders of wisconsin" reality show (although, one time Animal Planet called and wanted to film a "thats my baby" video here! A live whelping from one of our mommys! Our Schedule's were not compatible though. Still - exciting to be asked), no real acknowledgement-recognition from anywhere (excluding our past customers), no guest spots on radio shows, no gold watches, no retirement program, no benefits, no gifts, no letter of commendation, no paid vacations....yada, yada, yada.
>....having to pay for our own Education in cash-in full. There is no Breeding School to attend. We had to educate ourselves via training, other breeders, vet mentors, and the school of hard knocks. We invested too much time, money, and energy for the dogs. We invested in Quality Bloodlines to develope. And built our own library of costly supplies, guide and vet books / magazines... All of which is still ongoing. Seems like there's always something new to learn. ...and pay for.
...So yeah, despite all this - Amazingly, not only are we still ready and good to go...
...we are Motivated and Dedicated to push ahead!
All Wisconsin Reputable Breeders aspire to a realistic, reasonable, common
sense, and higher standard of Breeding altogether.
Thereby staying ahead of the Pack!
Fortunately, we've had decades of Quality & Appreciative puppy owners thoughout the years. And, to this We Can't Thank You Enough. Higher Standard People hang together, we figure. We know what we are and by you choosing us, out of all the other Breeders out there, we are honored.

Potential Puppy Buyer Experience: One potential buyer went to look at a purebred yorkie litter of puppies from a local Green Bay, Wiscosnin newspaper ad. While at the sellers home, the Dam of litter jumped up and bit the Prospective Buyer twice on the hand! Not a serious issue that needed stitches but bleeding and hand scratched up a few times was involved. The Dams owner - remarked, "oh - thats just a nibble she does to people from time to time". He offered a tissue to catch the dripping blood. And did not discipline the Dam. He didnt even remove her from the room. He proceeded with conversation like it never took place at all. The Dam herself was nervous, high energy, very vocal - barky, and didnt like strangers with or without her puppies. The visit ended promptly (w/o a puppy) after the owner showed no real concern.
Ask yourself, Should this Dam even be breed to being with? Remember, this is the Dam who gives meaning to the phrases: those little "ankle biters" (now hand bitters) and "little yappy dogs" or "hyper dogs". Either way, a ill tempered Dam can yield ill tempered puppies. Like 1-5 puppies per litter. Who can inturn be bred themselves, to produce more little ill-tempered puppies.
So, it goes w/ many backyard newspaper breeders offering cheaper puppies. Who breed anything with no real Guarantees. (the DATCP solution: take him to court)
